Overview
Landlords in Scotland have specific legal obligations. This page provides general information and is not a substitute for professional legal advice. UniqueLets encourages all landlords to understand and fulfil their responsibilities.
Legal Compliance
Landlords are responsible for:
- Ensuring the property meets legal safety standards, including gas, electrical and fire safety.
- Obtaining required certifications (e.g. gas safety certificate, electrical installation condition report).
- Complying with the Repairing Standard and other housing legislation applicable in Scotland.
- Protecting tenant deposits in an approved deposit scheme.
- Providing required tenant information packs and documentation.
Licensing and Registration
Landlords must be registered with the Scottish Landlord Register. Additional licensing requirements may apply depending on the property type, location and letting arrangement. Landlords are responsible for ensuring they hold all necessary registrations and licences.
Insurance
Landlords should ensure they have appropriate building and contents insurance, and that their insurer is aware the property is being let. UniqueLets does not provide insurance advice.
Tax
Landlords are responsible for their own tax affairs, including declaring rental income to HMRC. We recommend consulting a qualified tax adviser.
UniqueLets Role
UniqueLets provides property management and coordination support. While we assist with practical management, maintenance coordination and tenant communication, ultimate legal responsibility for the property remains with the landlord.
Seeking Professional Advice
This information is general and not exhaustive. Landlords should seek independent legal, tax and insurance advice relevant to their specific circumstances.
